These Terms of Service govern your access to and use of the Cherry Permits website, marketplace, property assessment tools and related services. By using Cherry Permits, creating an account, submitting a property or contacting us through the platform, you agree to these terms.
About Cherry Permits
Cherry Permits helps owners and authorised representatives of commercial, industrial and mixed-use properties understand possible outdoor advertising opportunities and connect suitable properties with relevant outdoor media participants.
Cherry Permits is a marketplace and property assessment service. Unless we agree otherwise in writing, we are not acting as your legal adviser, town planner, real estate agent, financial adviser or permit authority.
Eligibility And Commercial Use
You must be at least 18 years old and able to enter into legally binding agreements to use our services. If you use Cherry Permits on behalf of an organisation, property owner, landlord or other entity, you confirm that you have authority to do so.
Our services are intended for commercial property opportunities. We do not currently assess private homes, residential apartments, townhouses or residential land.
Using The Website And Platform
You agree to use Cherry Permits lawfully, honestly and for its intended purpose. You must not misuse the platform, interfere with its operation, attempt to bypass security controls, scrape or harvest data without permission, upload malicious files, impersonate another person, or use the service in a way that may harm Cherry Permits, our users or third parties.
You are responsible for the information, content, documents, images and communications you provide through the platform. You must ensure they are accurate, complete, lawful and not misleading.
Accounts
You may need an account to access certain features. You must provide accurate registration details, keep your account information up to date, keep your login details secure, and notify us promptly if you suspect unauthorised access.
You are responsible for activity that occurs under your account. We may suspend, restrict or close an account if we reasonably believe these terms have been breached, account details are inaccurate, or continued access may create legal, security or operational risk.
Property Submissions And Listings
When you submit a property, you confirm that you are the owner, landlord, authorised representative, manager, agent or another person with sufficient authority to provide the property information and discuss potential outdoor advertising opportunities.
You are responsible for ensuring submitted property information is accurate and that any photographs, documents, plans, title details, authority information, measurements or other materials are provided lawfully and with the necessary permissions.
Cherry Permits may review, edit, request clarification, decline, hide or remove property submissions or listings at our discretion, including where a property is outside our service scope, information is incomplete, ownership or authority is unclear, or the opportunity is not suitable for the marketplace.
Documents And Uploads
You must only upload files that you are authorised to provide and that are relevant to a legitimate Cherry Permits enquiry, listing, agreement, assessment or support request. Uploaded files may be reviewed for accuracy, relevance, safety and suitability.
We may reject, remove, restrict or quarantine files that are incomplete, incorrect, inappropriate, unlawful, unsafe, confidential without authority, infringing, misleading or unrelated to the marketplace process.
Publisher Interest And Agreements
Cherry Permits may share suitable property opportunities with outdoor media publishers, consultants or other industry participants. Any expression of interest is indicative only unless and until the relevant parties enter into a binding written agreement.
We do not guarantee publisher interest, advertising demand, final lease terms, permit approvals, council approvals, building approvals, advertising revenue, rental income, project timing or any commercial outcome. You should obtain your own legal, planning, tax, financial and property advice before signing any agreement or making decisions based on a potential opportunity.
Permits, Approvals And Site Suitability
Information provided by Cherry Permits about a property's potential suitability is general and preliminary. Outdoor advertising opportunities may depend on planning rules, road authority requirements, building approvals, safety standards, lease terms, site access, engineering, visibility, commercial demand and other factors.
Unless we agree otherwise in writing, you remain responsible for obtaining any required approvals, consents, licences, landlord approvals, body corporate approvals, mortgagee consents, insurance approvals or other permissions connected with a property or advertising installation.
Fees And Payments
Some Cherry Permits services may be free to use, while others may involve fees, commissions, referral arrangements or separately agreed commercial terms. Any applicable fees or commercial terms will be disclosed or agreed separately where required.
You are responsible for any taxes, costs, professional advice, third-party charges or expenses you incur in connection with your use of Cherry Permits or a property opportunity, unless we agree otherwise in writing.
Platform Availability
We aim to keep the website and platform available and reliable, but access may be interrupted, delayed, limited or unavailable because of maintenance, updates, third-party services, network issues, security incidents or technical problems.
We may change, suspend, withdraw or discontinue any part of the website, marketplace or services at any time. We are not liable for temporary unavailability or changes to the service except to the extent required by law.
Intellectual Property
Cherry Permits owns or licenses the platform, software, website design, branding, trade marks, content, processes, data structures and materials we provide, unless stated otherwise. You must not copy, reproduce, modify, reverse engineer, distribute or commercially exploit our intellectual property without our written permission.
You retain ownership of content you provide, subject to any rights held by others. By submitting information, documents, images or other content, you grant Cherry Permits a worldwide, royalty-free licence to use, copy, store, adapt, display, disclose and share that content as reasonably needed to operate the platform, assess properties, manage listings, communicate with relevant participants, provide services and enforce these terms.
Privacy
We handle personal information in accordance with our Privacy Policy. By using Cherry Permits, you acknowledge that we may collect, use and disclose information as described in that policy.
Third-Party Services And Links
The website and platform may contain links to third-party websites, maps, tools, payment providers, document services, analytics services or publisher platforms. Those services are operated by third parties and may have their own terms and privacy policies.
We are not responsible for third-party content, availability, errors, security, acts, omissions or policies, except to the extent required by law.
Disclaimers
To the maximum extent permitted by law, Cherry Permits provides the website, marketplace and services on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, secure, free from harmful code, or suitable for every property, user or commercial purpose.
Nothing in these terms excludes, restricts or modifies any consumer guarantees, statutory rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable laws.
Liability
To the maximum extent permitted by law, Cherry Permits is not liable for indirect, consequential, special or economic loss, loss of profit, loss of revenue, loss of opportunity, loss of data, reputational damage, or losses arising from reliance on preliminary site assessments, publisher interest, third-party actions, permit outcomes or platform unavailability.
Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having the service supplied again.
Indemnity
You agree to indemnify Cherry Permits, our officers, employees, contractors and service providers from claims, losses, damages, costs and expenses arising from your breach of these terms, misuse of the platform, unlawful content, inaccurate property information, lack of authority, infringement of third-party rights, or dealings with third parties connected with your use of the service.
Suspension And Termination
We may suspend, restrict or terminate your access to the website, account or services if we reasonably believe you have breached these terms, created risk for Cherry Permits or others, provided misleading information, misused the platform, or acted unlawfully.
You may stop using the services at any time. Terms that by their nature should continue after access ends, including intellectual property, privacy, disclaimers, liability, indemnity and governing law, will continue to apply.
Governing Law
These terms are governed by the laws of Queensland, Australia. You and Cherry Permits submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
Changes To These Terms
We may update these terms from time to time by publishing the updated version on this page. The revised terms apply from the date they are published, unless stated otherwise. Continued use of the website or services after changes are made means you accept the updated terms.
